Mobile Application Terms of Service and Privacy Policy
Effective Date: April 30, 2026  |  Applicable Entity: Creative Property Services Consultants Limited
By downloading or using this Mobile Application, you acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions (including the Privacy Policy).

PART I: TERMS AND CONDITIONS OF SERVICE

1. Definitions and Interpretation

• "Applicable Laws" refers to any current or future laws, ordinances, regulations, orders, judicial or administrative interpretations (including orders and rulings within the Hong Kong Special Administrative Region).
• "Content" refers to all data, information, text, images, videos, and other materials displayed, provided, or accessible within this Application.
• "Services" refers to property management services, notification alerts, clubhouse facility bookings, and other promotional activities that can be booked, applied for, purchased, or enjoyed through this Application.
• "User" or "You" refers to any individual or entity accessing or using this Application.
• "Company" or "We" means Creative Property Services Consultants Limited and its affiliates.

2. Service Provision and Modifications

2.1 Scope of Services: You may access and apply for property management services, facility bookings, etc., through this Application. The Company reserves the right to modify, suspend, terminate, expand, or reduce the types of services at any time and shall not be liable for any delays or interruptions in service resulting therefrom.

2.2 Termination of Service: If you violate the Terms, if your data cannot be verified, or if your conduct is inappropriate, the Company reserves the right to immediately terminate your access privileges.

3. User Code of Conduct

You undertake to use this Application solely for private and non-commercial purposes and are strictly prohibited from engaging in the following acts:

• Unauthorized Access: Hacking, attacking, or attempting to infringe upon the security of the Company's servers and systems.
• Posting Objectionable Content: Transmitting any content that is illegal, fraudulent, defamatory, obscene, threatening, or hate speech.
• Commercial Solicitation: Posting advertisements, chain letters, pyramid schemes, or other unsolicited commercial communications.
• Malicious Code: Transmitting harmful programs such as viruses, worms, or time bombs.
• Infringement of IP: Unauthorized copying, distribution, or exploitation of copyright-protected content.
• Disruptive Conduct: Interfering with network connections, password mining, or disrupting the normal experience of other users.

4. Intellectual Property Rights

This Application and its Content (including software, text, images, and interface design) are the property of the Company or its licensors and are protected by copyright and trademark laws. Without written permission, you may not modify, reverse engineer, or commercially exploit the same.

5. Disclaimer and Limitation of Liability

5.1 "As Is" Basis: This Application is provided on an "as is" and "as available" basis. The Company does not warrant that the service will be uninterrupted or error-free, nor does it warrant that downloaded content will not damage your device.

5.2 Exclusion of Liability: To the maximum extent permitted by law, the Company disclaims all express or implied warranties (including availability, accuracy, non-infringement, etc.). Unless it is a direct loss caused by the Company's gross negligence or willful misconduct, the Company shall not be liable for any indirect losses.

5.3 Third-Party Content: This Application may contain links or content from third-party websites. The Company is not responsible for their accuracy or legality, and you access them at your own risk.

6. Miscellaneous

6.1 Amendments: The Company reserves the right to revise the Terms at any time. The latest version will be published within the Application. Continued use constitutes acceptance of the amendments.

6.2 Entire Agreement: These Terms constitute the entire agreement between the parties regarding the use of this Application, superseding all prior oral or written agreements.

PART II: PRIVACY POLICY AND PERSONAL INFORMATION COLLECTION STATEMENT

1. Policy Commitment

The Company attaches great importance to the protection of personal data and strictly complies with the provisions of the Hong Kong Laws Chapter 486 "Personal Data (Privacy) Ordinance" (the "Privacy Ordinance").

2. Purposes of Collecting Personal Data

We collect your personal data primarily for the following purposes:

• Service Provision: Managing the estate, providing property management services, facility bookings, issuing notifications, and handling resident Octopus card registration.
• Identity Verification: Verifying your identity and processing receivables/payables.
• Communication: Responding to inquiries, complaints, and conducting service satisfaction surveys.
• Compliance and Analytics: Complying with legal and regulatory requirements and conducting data analysis to improve service quality.

3. Types of Data Collected

We may collect the following data to achieve the above purposes:

• Basic Information: Name, contact phone number, email address, and residential address.
• Technical Data: IP address, domain name, browser type, and access time (used for web logs and preventing abuse).
• Cookies Data: To enhance user experience, we may use Cookies to track your browsing preferences and interests.

4. Disclosure and Transfer of Personal Data

We will only disclose or transfer data to the following parties when necessary:

• Creative Property Services Consultants Limited subsidiaries and affiliated companies.

Under the Privacy Ordinance, you have the right to access and request correction of your personal data held by us. We may charge a reasonable fee for processing such requests.

PART III: COOKIES AND WEB TRACKING STATEMENT

When you browse this Application, Cookies (small text files) will be stored on your device. Their main purposes include: internal navigation and programming; expediting the login process; storing your interests and preferences to provide personalized services.

2. Third-Party Tracking

We may engage third-party service providers to analyze non-personal data to improve the quality of the Application. These third parties may combine the collected information with their other data.

3. User Choices

You may disable Cookies through your browser settings, but this may result in some features not functioning properly.

Creative Property Services Consultants Limited makes no warranty, express or implied, regarding the accuracy, availability, or completeness of the Application. To the extent permitted by law, the Company shall not be liable for any loss, damage, or injury arising from the use of this Application. All personal data collected is handled in accordance with the Personal Data (Privacy) Ordinance.
